9. Exceptions
Any exceptions to this policy, such as licensing for specific use, must be obtained in writing from the copyright owner. Exceptions approved include:

a) Images created in collaboration for the RunnersNZ project featuring interviews for the ‘Why We Run’ stories. These images will be provided to the individuals featured in the photograph without fee and solely for personal, non-commercial use. The featured individuals may view, download, and share images for your own private purposes, but you must not:

  • Use, reproduce, distribute, or alter the content for commercial purposes without prior written consent from Carly Webber and RunnersNZ Limited.
  • Remove, alter, or obscure any copyright or other proprietary notices contained in the images or on the website.
  • Use the images in any manner that suggests or states endorsement, ambassadorship or sponsorship by any commercial entities, unless explicitly approved.

10. Permissions and Licensing
Any other use of the website’s content, including but not limited to commercial use, requires a separate licensing agreement obtained in writing from Carly Webber and RunnersNZ Limited.

11. Social Media Use
In addition to the above, the following terms apply to sharing images on social media platforms:

  • You are permitted to share images from Carly Webber @carly_webber and RunnersNZ Limited @runnersnz on your personal, non-commercial, social media stories or feeds, provided you do not download, copy, or redistribute the original images outside the platform’s sharing features. For the definition of non-personal commercial use see Section 12.
  • When sharing, give proper attribution by tagging or mentioning our official social media accounts, RunnersNZ and/or @runnersnz.
  • You may not download, save, copy, or re-upload images from the website for reposting or other purposes outside the sharing features of the social media platform.
  • Any use of images for commercial promotion on social media requires prior written permission from Carly Webber and RunnersNZ Limited.

12. Definition of Commercial Use
For the purposes of this policy, “Commercial Use” includes, but is not limited to:

  • Bloggers and content creators who intend to monetise or promote products, services, or brands.
  • Brand ambassadors and representatives who create content for promotional or endorsement purposes.
  • Individuals or entities paid or compensated in any form for creating, sharing, or distributing content.
  • Any person or organisation that generates revenue, provides advertising, or promotes commercial activities.

    This definition applies regardless of whether compensation is monetary, in-kind, or through other means. Unauthorised use of images by any of these parties is strictly prohibited without prior explicit permission from the copyright holder.

13. Legal Action and Invoicing
If it is determined that copyright infringement has occurred, the infringing party may be subject to legal action. We reserve the right to issue an invoice for damages, legal costs, and any other applicable penalties as permitted under New Zealand copyright law. The infringing party will be notified of the invoice issued, which must be paid within a specified period as stated on the invoice.

The website and its content are provided “as is.” Carly Webber and RunnersNZ Limited makes no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of the content.
